Terms & Conditions

  • The agreement

This agreement consists of these terms, the information given during checkout, and any
separately agreed terms. It is supplemented by the relevant Norwegian consumer protection
legislation, including the Sale of Goods Act (forbrukerkjøpsloven), the Right of Withdrawal Act (angrerettloven), the Marketing Control Act (markedsføringsloven) and the E-Commerce Act (ehandelsloven).

Buyer: the consumer placing the order.

  • Price

The price shown for a course or membership is the total price to be paid, including all fees. TGF will not charge the buyer any additional cost that was not disclosed before purchase. All prices are stated in NOK and include VAT where applicable.

  • Formation of the contract

The agreement is binding on both parties once the buyer has submitted the order. It is not
binding if there was a clear input or pricing error and the other party realized, or should have
realized, that such an error existed.

  • Payment

Payment is collected online at checkout via Vipps and/or card (Stripe). 

For digital course access, access is granted after payment confirmation.

  • Access to content (delivery)

Courses: access is granted directly on the website through Tutor LMS Pro once payment is confirmed. Access is normally granted immediately, and no later than 2 hours after payment confirmation.

Memberships: the member receives a confirmation email and membership card once payment is confirmed. Confirmation and membership card are normally issued within 2 hours, in the order confimation email.

  • Right of withdrawal

Under the Right of Withdrawal Act (angrerettloven) § 21, consumers generally have 14 days to cancel a purchase, starting the day after purchase.

However, for digital content the right of withdrawal does not apply, when this is delivered immediately, and when the consumer has expressly agreed to immediate delivery and has acknowledged that doing so means losing the withdrawal right.

If the membership includes immediate access to digital membership benefits, content, or services, the right of withdrawal applies in accordance with the applicable withdrawal regulations. If the member expressly consents to the delivery commencing before the expiry of the withdrawal period and acknowledges that this results in the loss of the right of withdrawal, in whole or in part, the membership cannot be cancelled for a refund once access has been granted.

  • Late or non-delivery

If TGF fails to grant access or deliver the membership confirmation as agreed, and this isn’t the buyer’s fault, the buyer may, depending on the situation, withhold payment, demand fulfilment, cancel the agreement, and/or claim damages, in line with the relevant provisions of the Sale of Goods Act. Complaints on this basis should be made in writing (email) within reasonable time.

  • Non-conformity / issues with the course or membership

If there is a problem with the course content or membership service that isn’t the buyer’s fault, the buyer should notify TGF within reasonable time after discovering it. A complaint made within 2 months of discovery is always considered timely.

  • Personal data

TGF is the data controller for personal data collected through the website. Only the personal data necessary to fulfil the order (name, email, payment confirmation, etc.) will be collected and stored, in line with Norwegian and EU data protection law (GDPR/personopplysningsloven), unless the buyer consents to something else. 

  • Liability

TGF is not liable for any injury, loss, or damage arising from participants or third parties failing to follow, or choosing to follow, advice, instructions, or other information provided in the course materials. TGF is a guide association that provides guidance and instruction as a basis for each participant’s own responsibility and judgment. Each participant is solely responsible for assessing whether and how to apply the information provided.

  • Dispute resolution

Complaints should first be sent to TGF at info@tromsoguideforening.com within reasonable time. The parties will try to resolve any dispute amicably. If that fails, the buyer can contact Forbrukertilsynet (the Norwegian Consumer Authority) for mediation, phone +47 23 400 600, https://www.forbrukertilsynet.no.
